Terms of Service

RIGHTS

These terms and conditions are strictly for Non-Commercial/Personal-Use only clients.
For commercial based inquiries, please email [email protected] to discuss further options and state clearly in the subject that your request is for commercial use.The artist: Fox Bakudan/Darby Atwood reserves the right to refuse service at her own discretion. Art created by Fox Bakudan/Darby Atwood is strictly prohibited from being used in any AI generation/AI processing in any form.The artist: Fox Bakudan/Darby Atwood maintains all rights to all artwork including all various stages leading up to and the completed work. Artwork may be used for but not limited to portfolios (physical and online), examples, prints, social media, art advertisement, and Patreon rewards. Client maintains all rights to character ownership and/or concepts and will be accredited in any public posts or social media.Clients who share the completed artwork to their online collections or social media platforms must credit the original artist: Fox Bakudan/Darby Atwood. This includes profile pictures or background images for personal websites. Do not claim the completed artwork as your own and removal of watermarks or signatures is strictly prohibited. AI processing of private commissions is also prohibited.
This is non-negotiable.

Commercial Revenue & Resale

Clients do not have permission to sell or use commissioned artwork for personal revenue. This includes but is not limited to prints, t-shirts, stickers, bags, keychains, etc. featuring the commissioned work is strictly prohibited if not purchased directly from the artist. Requests for these items for personal use only must be approved by the artist before purchase.

Revisions

Any and all edits to the artwork must be done by the artist. The client does not have permission to make any revisions to the completed artwork. This includes but is not limited to cropping to make icons, banners, backdrops, etc. Removal of original watermarks or signatures is prohibited. If the image is for something specific like an icon or banner, please provide exact dimensions in your order so the completed artwork can be customized to the correct specifications. Any revisions to the artwork must be stated by the client during the preliminary sketching phase. Any revisions requested by the client during the lining phase may be subjected to a fee per the artist’s discretion. No revisions will be done once the artwork is completed.

Payment & Refunds

All prices listed are final and non-negotiable. All payments will be done through PayPal invoice only. Please be sure to include your PayPal email in your order. The invoice must be paid IN FULL before the artist will proceed with any art. Payment plan and discount options may be available for returning clients with good payment history per the artist’s discretion. If payment is not completed within 48 hours of the invoice being sent, the commission will be canceled. As soon as the art process has started, there will no longer be any refunds available, regardless if the client cancels before the commission is completed. A full refund can only be given if the client has paid and the artist has not started any work on the art piece.

Time frames & Deadlines

Due to personal scheduling, projects will have no set time frame or deadline for completion. Any projects requiring a deadline or set time frame for completion may be declined per the artist’s discretion. Any cancellation of a commission order due to prolonged time frame by the client in which the artwork has already been started, will be done so with the full knowledge that there will be no refund given. PayPal “charge-backs” or disputes submitted by client due to prolonged time frame after the artwork has been started will result in a blacklisting and any future commission privileges being revoked.

Privacy

Commission information including but not limited to client’s online username, character name, commission type, color preference, and invoice number may be posted via public Trello kanban board in order to track commission progress both for the artist and client. If there is any information concerning the commission that the client does not want posted publicly, it should be specified in the order or via email correspondence with the artist. For confidentiality and security purposes, client’s full name will never be posted publicly unless prior consent is given. Artwork is subject to public online streaming unless otherwise explicitly specified by the client.

NSFW

NSFW options are available for 18+ clients and will be discussed privately via email or discord message. Should the artist suspect false age is being displayed, the commission will be rejected. The artist reserves the right to deny the commission based on personal preference and comfort levels. NSFW artwork is limited to two characters and subject to extra fees which will be discussed on a case by case basis. Clients are prohibited from requesting themselves or their characters paired with the artist or original characters belonging to the artist without prior consent.

PWYW "Experimental" Grab Bag

The minimum starting price for the PWYW (pay what you want) Experimental Grab Bag art is $35.This will guarantee at least a flat color headshot or a half body sketch at minimum.
The more money offered, the more effort that generally goes into your piece.
Also how much I like the character and my mood can affect the outcome.You could end up with a full body sketch, tinted half body sketch, a sketch with flat color, partial rendering and textures, basically whatever I'm feeling.By choosing this option you acknowledge that you get what I give you, there will be no edits, and you have no control over the piece.SO PURCHASE AT YOUR OWN RISK.But if you like surprises and have a little cash to spend, this is the choice for you!

Paper Doll Reference Sheets

Staring Price: $150
Extra Outfit: $25 - $45*

The starting price includes up to 5 full body, sketch lined (not completely crisp/polished), flat colored images of ONE character in the same pose featuring various stages of undress including:-Completely Naked
-One set of Lingerie/Under Clothes
-One Outfit (in various pieces)The price can go up from the normal starting price depending on the complexity of the base character, the complexity of the primary outfit, or adding multiple outfits instead of just the one in various pieces.*Price depends on complexity of the outfit.I will only be accepting ONE reference sheet per opening as they are time consuming.

Couples are currently not being offered at this time with only certain exceptions.

Work In Progress

Currently there will only be three slots open at a time.
All other requests will be placed on the waiting list.
Waiting list requests will have priority when new slots open up.I apologize for the inconvenience, but I work slow and this is to help me from getting overwhelmed.Thank you for understanding.
